Rosenberg City Council member may have been arrested Tuesday, but that didn’t stop him from attending that evening’s council meeting. Which is a good thing, because his attendance, or lack thereof, was on the agenda.

Council member Isaac Davila requested that the council discuss the attendance of Balderas as it relates to city charter.

At the beginning of the year, Balderas missed three out of four meetings. However, the absences were not consecutive.

According to the city’s rules of procedure, “If a member of City Council shall be absent from three regularly scheduled meetings without a valid excuse, the member shall at the discretion of City Council, forfeit his/her office.”

And in the city charter it states, “The city council shall determine its own rules of procedure and may compel the attendance of its members.”

“I guess I’d like to know what his plans are,” Davila stated. “Is he going to attend the rest of the meetings? Given the opportunity, if he’d like to step down and resign, we could fill the position for three months.”

Mayor Bill Benton expressed his concern for Balderas’ absence from council.

“I have missed a couple meetings in the past, but as long as I’m on council, I will attend regularly scheduled meetings and workshops,” Balderas vowed.

Benton said if he were to miss, Balderas should contact the city manager and city secretary beforehand.

“I’ll definitely notify within at least an hour’s notice,” Balderas replied.

At the first meeting in February, Davila called for Balderas’ resignation. According to City Attorney Grady Randle, council does not have the authority to remove anybody from office.

Davila said he brought this item to council at the beginning of the month because the council needs a seventh person as a tie-breaker when voting.

“That’s all I wanted,” Davila said. “I wanted seven people to vote. Thank you.”

Balderas did not re-file for the May 1 election. He has served on council since 2017.
